These terms are an agreement between you and SoTrace. By accessing or using the service, you agree to them. If you do not agree, do not use the service.

The service
SoTrace is a social listening platform that collects publicly available mentions from third-party networks, analyzes them, and presents them to you through a dashboard and an API (the "Service"). We may add, change, or remove features at any time.
Your account
You are responsible for your account, for keeping your credentials secure, and for all activity that happens under it. Provide accurate information, and let us know promptly of any unauthorized use. You must be legally able to enter into these terms to use the Service.
Acceptable use
You agree not to:
- use the Service in violation of any law or regulation, or of the rights of any third party;
- use it to harass, surveil, or harm individuals, or in any way that violates the terms or policies of the networks the mentions originate from;
- attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
- resell or redistribute the Service except as expressly permitted.
Third-party content and platforms
The mentions shown in the Service are created by third parties and obtained from platforms we do not operate or control. We do not endorse that content and cannot guarantee that it is accurate, complete, current, or continuously available. Your use of information from third-party platforms is subject to their terms, and complying with those terms is your responsibility.
No professional advice
The Service and its analysis are provided for general informational purposes only. They are not legal, financial, public-relations, or other professional advice, and you should not rely on them as such. Any decision you make based on the Service is your own.
Service availability
We work to keep the Service available and reliable, but we do not promise that it will be uninterrupted, timely, secure, or error-free, or that any mention, metric, or alert will be delivered or accurate. We may suspend or discontinue all or part of the Service at any time.
Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty as to the accuracy, completeness, reliability, or availability of the Service or of any content or results obtained through it. You use the Service at your own risk.
Limitation of liability
To the fullest extent permitted by law, SoTrace and its owners, contributors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages, and regardless of the legal theory.
To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred (100) US dollars.
Indemnification
You agree to indemnify and hold harmless SoTrace from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms or if we reasonably need to in order to protect the Service or its users. Provisions that by their nature should survive termination, including the disclaimers, limitation of liability, and indemnification, will survive.
Governing law
These terms are governed by the laws applicable at the principal place of business of the operator, without regard to conflict-of-law rules. Nothing in these terms limits any rights you may have that cannot be waived under the law that applies to you.
Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the date above. By continuing to use the Service after changes take effect, you agree to the revised terms.
